Wrongful Deaths in Mississippi
When a member of your family dies unexpectedly in a preventable accident, the resulting economic and emotional burdens will most likely be enormous. Sadly, wrongful deaths can stem from many different kinds of accidents, including those that involve:
- Motor vehicle accidents
- Dangerous or defective products
- Medical malpractice
- Premises liability
- Defective medical devices
- Workplace illnesses or injuries
- Hunting accidents
- Farming accidents
Even though some cases of wrongful deaths occur right then at the time of the incident, other victims could face days, weeks, or months of ongoing medical treatment or life support before they finally succumb to their injuries.
In these circumstances, families are not only left with their grief but significant medical bills, along with the added burden of the missing the contributions, financial and otherwise, the deceased would have made to the household. Our firm of experienced attorneys work hard to obtain fair financial compensation to cover various damages including:
- Medical costs
- Burial expenses
- Lost income
- Loss of consortium
- Pain and suffering
For especially egregious displays of negligent behavior, the court might also decide to award punitive damages. Punitive damages are intended to serve as an additional punishment for the defendant, as well as discourage others from acting in the same or a similar manner.
The persons allowed to file a wrongful death claim vary with each individual state. In Mississippi, a surviving child or surviving spouse may file a wrongful death lawsuit. A personal representative of the deceased’s estate can also file a claim and, in some situations, the siblings or parents of the deceased party.
All states also have a limitation on the time you are given to file this kind of claim. Typically, a wrongful death suit in Mississippi has to be filed no later than three years from the day of death. Some cases, however, such as those involving government entities or medical malpractice, are subjected to an even smaller time frame. To ensure that you are in compliance with the numerous regulations that surround these claims, we urge you to obtain the legal guidance of a skilled attorney as quickly as possible.
A skilled Vicksburg wrongful death attorney will be able to help you construct a strong claim, and ensure that the responsible party is held financially accountable for the role they played in your accident.
We have a well-established track record of making sure that our injured clients obtain the fair and full financial compensation that will truly cover their damages after a wrongful death.
