Injuries Caused by Defective Products in Mississippi
Products liability is the area of law that deals with a manufacturer’s or vendor’s responsibility to provide compensation for any injuries caused by defective goods that were sold. Under Mississippi product liability laws, manufacturers are obligated to make sure that their products are safe for use by consumers and come with ample and effective warnings that alert consumers to any potential problems or risks that could occur during the product’s use.
As stringent as these guidelines are, consumers rarely worry about products they have purchased being defective and, therefore, dangerous. Unfortunately, accidents resulting in serious injuries happen every because of defective products such as motor vehicles, kid’s toys, prescription drugs, and machinery.
A manufacturer has a duty to ensure that the design of their product is as safe as possible. If they are unable to meet this criterion, their duty then becomes to provide adequate warning to the public about the dangers associated with the product’s use.
Likewise, consumers have a duty to be as cautious as any reasonable person would while using the product. In the event that the product is clearly misused by the consumer, they will not be eligible to recover damages no matter how badly they were injured.
In order to have a valid products liability claim, you will have to show that the following four elements existed:
- You sustained a significant injury
- The product you were using was determined to be defective
- That product defect was the direct cause of your injuries
- You were using the product in the manner in which it was intended
