Picayune, MS (May 14, 2022) - A female passenger who was riding in a vehicle when the driver decided to evade police died in the hospital on Thursday, May 12th.
An official with the Pearl River County Sheriff’s Department said that the incident began at about 9:30 p.m. when the driver of the vehicle attempted to elude a checkpoint within the city limits of Picayune.
A short while later, sheriff’s deputies were dispatched to a location on Liberty Road in response to a one-car collision.
Upon their arrival, deputies located two people inside the wrecked vehicle, 53-year-old Jeffery Brawdy of Huntington Drive, and a female passenger whom Brawdy deliberately misidentified.
The passenger was taken by medical helicopter to Forrest General Hospital.
Brawdy was transported via ambulance.
Investigators determined that the crash occurred due to Brawdy’s efforts to dodge law enforcement.
Picayune Police Department Assistant Chief stated that earlier in the evening, Brawdy was witnessed approaching a police checkpoint and then trying to avoid the officers stationed there.
After he fled the checkpoint location, an officer gave chase but eventually lost sight of the vehicle. After informing dispatch of the vehicle’s whereabouts and furnishing them with a description of the vehicle, he ended his pursuit.
The female passenger, who has since been identified as 46-year-old Kerri Phillips, sustained critical injuries and was med flighted to a regional trauma center. She passed away over the weekend.
The incident is under investigation. Police have said that charges may be filed against Brawdy at a later date.
We would like to offer our deepest condolences to the family of the deceased victim, Ms. Kerri Phillips, at this time.
Passenger Rights in a Mississippi Car Accidents
Passengers are in a unique position when it comes to car accidents in Mississippi. An injured passenger is rarely responsible for the incident, however, this does not mean they are any less likely to sustain injuries during a crash.
Passengers are vulnerable to the very same injuries as drivers, including traumatic brain injuries and broken bones. Regardless of what caused the accident, it is most likely that someone other than the passenger is liable for their injuries.
In Mississippi, auto insurance coverage is a must for all drivers. In the event of a passenger-injury accident, this coverage will be used to pay for any damages endured by a passenger so they can start putting their life back together.
Typically, filing a claim against an insurance carrier only results in a settlement offer so low, that it might not even cover the claimant’s basic medical expenses. Anytime an insurance adjuster makes an initial offer, you should speak with an experienced personal injury attorney in Mississippi before you accept it.
A free consultation with one of our passenger injury lawyers can provide you with a full understanding of the nuances of your claim, what medical bills to expect now and in the future, and the estimated value of your claim before you consent to a devalued settlement offer.
