Wrongful Death Entitlements in Mississippi
The relatives closest to the deceased in terms of blood or marriage are generally the ones permitted to bring a wrongful death claim, which is filed in the interests of the deceased’s surviving family members. In order to correctly establish exactly who is able to file a wrongful death claim, you will need to speak with a Mississippi wrongful death attorney.
Typically, a spouse is the first relative in line to bring a claim for compensation to then keep or distribute amongst members of the family, like their children, as they find appropriate. In many cases, the deceased is not married. In this situation, their children, provided they have any, would be entitled to file a wrongful death claim. There is no one set answer as entitlement differs from claim to claim (and state to state) and can be impacted by a variety of influences.
This is one of the reasons it is so essential to consult with a practiced lawyer. It is unusual, but not unprecedented, for the family member bringing the claim to be a parent, sibling, aunt, or uncle although it is much harder to obtain a settlement award in those cases.
The losses that aggrieved families are qualified to receive in a wrongful death case will vary dramatically depending on the circumstances leading up to the death. There are numerous factors that must be taken into account when calculating damages in a wrongful death, most of which are, unsurprisingly, virtually impossible to assign a value to.
A skilled Mississippi wrongful death attorney will know the best and quickest way to prove negligence in your family member’s death. They can compose a persuasive claim and ensure that the at-fault party is held financially accountable for the role they played in the death of someone you love.
