Deadly High-Speed Crashes in Mississippi
Everyone on the road is put at risk when someone is speeding. In the year 2020, 11,258 persons lost their lives because of speeding. Generally speaking, a wrongful death occurs when the activities of another party are the direct cause of a person's passing away. There is a good chance that you have a solid case for wrongful death if you can demonstrate that your loved one would still be alive if it weren't for the conduct of the defendant.
Your claim for wrongful death cannot be resolved favorably unless you can provide evidence demonstrating that the defendant was responsible for the passing of a family member or other loved one. You are required to place this responsibility, known as the burden of evidence, on the other person that you are making the claim. If the death was caused by negligent action, you would need to demonstrate that the defendant could have or should have behaved in a different manner to protect your loved one from danger.
