Wrongful Death Entitlements in Mississippi
Those closely related to the deceased will usually be allowed to file a wrongful death claim. These claims are brought on behalf of the deceased’s surviving family members. You can properly determine who is entitled to bring a claim by speaking with a wrongful death lawyer in Mississippi.
Generally, a spouse will be the first surviving relative in line to file the claim and be awarded compensation to then have or disperse among family members, such as their children, as they see fit. In some instances, the victim is unmarried. If this is the case, their children, if they have any, would be eligible to file a claim. Entitlement varies from claim to claim and can change for a variety of reasons.
This is just one of the reasons why it is important to confer with an experienced attorney. It is uncommon, but not unheard of, for the relative filing the claim to be a sibling, uncle, aunt, or parent although it is much more difficult to be awarded a settlement in these cases.
The damages aggrieved family members are entitled to collect in a wrongful death claim vary significantly based on the events surrounding the death. There are multiple factors that go into calculating compensation for a wrongful death, such as:
- The pain and suffering your family member endured prior to their death, also known as a survival action
- Any medical expenses that were incurred due to the deceased’s injury and subsequent treatment intended to preserve life
- Burial and funeral costs/ Cremation expenses
- The loss of the income the deceased would have contributed to the household during the course of their lifetime
- The inheritance eligible family members would have received had the victim survived
- Loss of consortium
- Loss of service or association that the deceased provided
- Loss of companionship
Many of these damages are, understandably, nearly impossible to assign a dollar amount to.
