Forest, MS (June 05, 2022) - On Thursday, June 2nd, at about 3:45 p.m., deputies from the Attala County Sheriff’s Department responded to requests for traffic control assistance after a truck towing a mobile home broke down.
As deputies were responding to the scene in the northbound lanes of Highway 35 in Forest, a pick-up truck crashed into the disabled vehicle, causing it to overturn into a roadside ditch.
One person was taken by ambulance to an area hospital for treatment of unknown injuries.
Our thoughts are with the injured victim and their family at this time. We hope for their full recovery.
Fault for Car Accidents in Mississippi
The state of Mississippi is fault-based and it upholds a compensation system based on pure comparative negligence.
The pure comparative negligence approach allows someone to file a claim for injuries they sustained in a car crash and recover for those damages even if they were partially or mostly responsible for causing it. Comparative negligence procedures allocate each person a degree of fault. After that, compensation is awarded commensurate to each person’s degree of liability for the accident.
Fault is a partial defense, meaning it does not fully absolve the defendant of guilt, and it will lessen the damages awarded. This is due to the fact that the rules of pure comparative negligence permit some damages to be awarded irrespective of fault, but the dollar value of that award will be diminished based on that person’s degree of fault for the accident. If you were injured in a Mississippi car accident, we strongly urge you to begin the claims process right away. Under Mississippi law, you have 10 days to file a written report with law enforcement if the losses from that accident are worth more than $250.
If you experienced significant injuries caused by the recklessness, negligence, or misconduct of another person, we are here to assess your potential personal injury claim. Contact our Mississippi personal injury attorneys by calling our law offices at (601) 487-0555 to schedule a case evaluation.
