Train Accidents in Mississippi
Each year, throughout the United States, roughly 800 victims are killed and several thousand more are injured during accidents involving trains. When compared to the fatality and injury totals generated by motor vehicle crashes, these numbers may appear tiny small but, in actuality, equal two fatal train accidents every day.
There are numerous kinds of train accidents that can take place under a countless number of circumstances. Some common examples include:
- Accidents at railroad crossings
- Train derailments
- Trains crashing into motor vehicles
- Train crashing into other trains
- Trains striking a pedestrian
The majority of train accidents that take place in the United States occur at railroad crossings. A vehicle could stall out on the tracks, traffic could be backed up resulting in a vehicle being on the tracks at a crossing that does not have any safety bars to come down. Occasionally, when train crossings are unmarked with safety bars or lights, motor vehicles can collide with oncoming trains in the dark.
Before you can pursue financial compensation for an injury caused by a train accident, you will first have to prove that negligence on the part of the railway company, the train operator, or the driver of another automobile was responsible for the accident.
The National Transportation Safety Board is in charge of conducting the investigations surrounding Amtrak derailments and accidents. After the official report has been published, your Mississippi train accident lawyer will begin building a case that shows exactly how the at-fault party’s negligence or recklessness was the immediate cause of your accident and subsequent injuries.
Due to being a common carrier, the railways, Amtrak operators and conductors, mechanics, railway maintenance workers, and other railway workers have a responsibility to the public to ensure that transportation on their trains is as safe and hazard-free as possible.
When a train conductor, operator, or other employee violates the duty of care they owe to the train’s passengers, as well as those in the area, and that violation is proven to be the direct cause of your injuries, you most likely have a valid train injury claim.
