Filing a Wrongful Death Claim in Mississippi

, Biloxi, MS - Jonathan Harlan Identified as Pedestrian Killed on I-10 Near Cedar Lake Rd, Germany Law Firm PLLC

In Mississippi, wrongful death claims can only be filed by specific family members of the deceased, including:

  • Surviving siblings
  • Surviving parent or child
  • Surviving spouse
  • A personal representative of the estate

The majority of these claims are usually brought by the decedent’s spouse. If they had any children, any awarded damages will be divided equitably between the surviving children and spouse. If the decedent was single or not lawfully married, a surviving sibling or parent can pursue a claim of wrongful death. Reaching out to a Mississippi wrongful death attorney will help you get the legal guidance you need to bring a viable wrongful death claim.

In Mississippi, claimants in a wrongful death claim can be awarded recovery for two types of damages: economic and non-economic.

  • Economic damages: Economic damages are intended to compensate the deceased’s family for quantifiable, calculable damages. These can include medical expenses incurred by the victim prior to their death, funeral and burial costs, lost income and other earnings, and property damage.
  • Non-economic damages: Non-economic damages are meant to act as financial compensation for other kinds of damages that are more challenging to put a dollar amount on, like the victim’s pain and suffering, emotional anguish, loss of consortium, and loss of companionship.

The forms of compensation and the total amount awarded will differ based on the unique circumstances of your claim. The best way to calculate the value of your wrongful death claim is to ask an experienced attorney.

Every state has its own set of rules regarding how long someone can wait between an event and a lawsuit pertaining to the event. This time period is known as the statute of limitations and it varies from state to state. The type of suit you are filing is also a significant factor.

There are two distinct statutes of limitations that apply to wrongful death cases filed with Mississippi state courts:

  • A claim of wrongful death has to be filed within one year from the date of death if it was the result of a deliberate act
  • A claim of wrongful death has to be filed within three years from the date of death if it was the result of negligence

Some states, however, have a statute of limitations that is as short as one year while other states have one as long as six years.
