Babies are fragile human beings that require constant attention, care, and support from their parents. In addition to caring for their babies, parents also have to accomplish other tasks and responsibilities during the day and night. Because of this, there are a plethora of baby products that are available for parents to use which can give them assistance to free up their hands. These products are meant to soothe and safely hold a baby. Baby loungers are one such example. These products are made to be comforting and supportive to babies while their parents are taking a break or trying to accomplish other undertakings.
While you expect that any product approved for the market is going to be safe for your child, this is not always the case. And sometimes it takes severe injury and death for a product to be deemed flawed and then, have a recall issued.
In these instances speaking to an experienced attorney can be helpful for victims who were injured by a defective product to learn more about their options for obtaining financial compensation for losses. The Jackson wrongful death attorneys at Germany Law Firm, PLLC have more than 40 years of experience helping victims obtain the most favorable results after filing a claim.
Unsafe Baby Loungers
Like any type of product category, there can be various brands or models that exist with flaws that make them dangerous to the user. The Consumer Product Safety Commission has investigated baby loungers for safety in the past. The CPSC concluded that not every product was risk-free. Specifically, products that were firm, and not soft whose incline was no more than 10 degrees were the best choice for parents.
An example of an unsafe baby lounger that put the public at risk was made by the Boppy Company. This popular baby product manufacturer came under fire for their baby loungers posing a grave threat to infants. According to the Consumer Product Safety Commission, the Boppy Company Original Newborn Lounger, Boppy Preferred Newborn Lounger, and the Pottery Barn Kids Boppy Newborn Loungers had to be recalled after eight babies lost their lives while using these products.
The product was available for consumer purchase from 2004 through 2020, before being recalled in September of 2021 after the reported infant deaths. The problem that was cited was the susceptibility of infants to roll or move to a position in the lounger that could cause suffocation and death. Completely rolling off of the lunger was also reported as a deadly issue with use.
In the United States, over three million of these loungers were sold and more than 30,000 throughout Canada. Individuals that returned their Boppy products were given a refund.
Boppy responded to the deaths with a statement indicating that they were “devastated” when they were informed of what happened. The company asserted to the public their commitment to helping communicate information regarding the safe use of their products and the importance of reading all instructions beforehand. In their defense, Boppy maintained that their product was not made for sleeping which should always be supervised by parents.
